Legal overview:

 
 

•  The Luri River Development Company has leased the Luri Riverwaterfront Development Plot from the Luri River Community of the Bari North
   Payam, for a period of 33 years commencing April 2nd 2009.

•  The Town Planning Board of the Directorate of Lands & Town Planning at the Ministry of Physical Infrastructure of the Central Equatoria State
   Government approved the plan for development of the Luri River Development at a sitting no. 2/2010.

•  The Directorate of Lands & Town Planning at the Ministry of Physical Infrastructure of the Central Equatoria State Government issued the land    lease to Luri River Development Co. Ltd on 14th June 2010 under reference number MPI/Dl&TP/CES/38.A.1.

•  The Luri River community have confirmed that the Luri River Development Company are entitled to sublease and / or rent various plots on the
    Luri River Waterfront land to third parties for the duration of the sublease agreement.

•  Should Southern Sudan property law be changed to allow for granting of freehold, LRDC and the community will meet and negotiate in good faith
   to convert the lease hold to freehold.

•  Benjamin Sogora from Sogora and Co Advocates, is the legal expert and representative on all Luri River Waterfront sub lease and rental
   agreements.


 
 

Luri River Waterfront Regulations:

•  LRDC will charge a monthly levy which will cover security, roads infrastructure and Luri River Waterfront maintenance.

•  LRDC will provide water, electricity & sewage services to the plots. The cost of these services will be charged on a
   “pay as you go” / metered basis.

•  Building plans will be subject to approval from Luri Development Company.

•  Regulations require that all building plans must be endorsed by a Sudanese registered architect and any building of
   greater than 2 levels must be signed off by a Sudanese registered consulting engineer.

•  All building to be built within LRDC stated guidelines (refer sub lease agreement / legal offer to sub lease documentation).

•  LRDC to construct / develop all residential building contracts.
